LibreCall recognizes that its customers, visitors and users, want to know LibreCall’s Privacy Policy. This Privacy Policy is made available to help you make an informed decision about whether to use or continue using the LibreCall Site, LibreCall Licensed Application and/or the LibreCall Service. If you do not agree to our practices, please do not use the LibreCall Site, LibreCall Licensed Application, or LibreCall Service.
Your use of the LibreCall Site, LibreCall Licensed Application and the LibreCall Service and any personal information you provide on the LibreCall Site or LibreCall Service remains subject to the terms of this Privacy Policy and our Terms of Service.
By visiting the Site or using the Service, you are accepting the policies and practices described in this Policy, as such Policy may be amended from time to time. Each time you visit the Site or use the Service, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy.
To be clear about the terminology we are using, when we use the phrase "Personal Information" in this Policy, we mean information about you that is personally identifiable, like your name, address, e-mail address, billing information, mobile network operator or phone number, as well as other non-public information that is associated with this personal information. When we use the phrase "Anonymous Information" in this Policy, we mean information that is not personally identifiable, or linked to your Personal Information such as aggregated information, general demographic information and IP addresses. Anonymous Information does not necessarily enable identification of individual persons.
This Privacy Policy does not apply to the practices of companies that LibreCall does not own or control, or to individuals whom LibreCall does not employ or manage, including any of the third parties to which LibreCall may disclose user information as set forth in this Privacy Policy.
When you install the Service on your device and register with LibreCall, personally identifiable information about you may be collected during the download process for the Service (as requested from you during the download process) when you register with us. For registration through LibreCall, you are only required to provide your mobile phone number and confirm your mobile network operator.
When you install the Service on your device and register with LibreCall, you will be asked to allow us access to your address book. If you consent, we will have access to contact information in your address book on the devices you use for the Service (names, numbers, email addresses, and Facebook ID, but not notes or other personally identifiable information) and we will store it on our servers and use it to help you use the Service. A copy of the phone numbers and names in your address book (but not emails, notes or any other Personal Information in your address book) will be stored on our servers.
In addition, LibreCall may collect and store information about your and others’ usage of, and interaction with, the Service and our websites, including calls, numbers of calls made by members, and to whom, call durations, text messages, information relating to games played through the Service (such as the games played, your game scores and how often you play), usage by geographies, device and connection information (such as MAC address), IP address, device capability, bandwidth, web browser software, referring website, statistics on page views, network type and traffic to and from our websites.
When we serve advertisements to your device, we collect information about your interaction with this advertisement to help us evaluate the performance of the advertisement that we show, such as whether you clicked on it, or installed the advertised product.
By choosing to share that information, you should understand that you may no longer be able to control how that information is used and that it may become publicly available (depending in part on your actions or the actions of others with whom you have shared the information). LibreCall is not responsible for any use or misuse of information you share.
When you visit the LibreCall Site, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. LibreCall uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, the LibreCall Site may not function properly if the ability to accept cookies is disabled.
When you use the LibreCall Site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, one or more cookies that may uniquely identify your browser, your phone number, phone number you are requesting the status of and various status information. Your IP Address is used to help identify you and to gather demographic information about our members and users as a whole, but does not include personally identifiable information. Our server may also record the referring page that linked you to us (e.g., another web site or a search engine); the pages you visit on this Site; the web site you visit after this Site; the ads you see and/or click on; other information about the type of Web browser, computer, platform, related software and settings you are using; any search terms you have entered on this Site or a referral site; and other Web usage activity and data logged by our servers. We use this information for internal system administration, to help diagnose problems with our servers, and to administer our Service.
We may use "clear GIFs" (aka "Web beacons" or "pixel tags") or similar technologies, in the Site and/or in our communications with you to enable us to evaluate Site usage information about visitors to the Site, target campaigns, upgrade visitor information, and know whether you have visited a Web page or received a message. A clear GIF is typically a one-pixel, transparent image (although it can be a visible image as well), located on a Web page or in an e-mail or other type of message, which is retrieved from a remote site on the Internet enabling the verification of an individual's viewing or receipt of a Web page or message. A clear gif may enable us to relate your viewing or receipt of a Web page or message to other information about you, including your Personal Information.
Any or all of these activities with regard to Site usage information may be performed on our behalf by our service providers, including, for example, our analytics vendor(s) and our e-mail management partner(s).
LibreCall does not collect names, addresses or other contact information from its users’ mobile address book or contact lists other than mobile phone numbers—the LibreCall mobile application will associate whatever name the LibreCall user has assigned to the mobile telephone number in his/her mobile address book or contact list — and this occurs dynamically on the mobile device itself and not on LibreCall’s servers and is not transmitted to LibreCall. This means that if you have your friend’s mobile phone number associated with the name “Juan” in your mobile address book, that’s the name that will appear for that mobile phone number in your LibreCall contact list.
We do not rent, sell, or share any information about the user with any third parties, except as specifically described herein. We may disclose your Personal Information if we believe such action is necessary to:
(a) Comply with the law, or legal process served on us;
(b) Protect and defend our rights or property (including the enforcement of our agreements); or
(c) Act in urgent circumstances to protect the personal safety of users of our Service or members of the public.
We may from time to time ask you to confirm your mobile number and mobile network operator, or provide information about your experiences, which will be used to measure and improve quality. You are at no time under any obligation to provide any of such data. Any and all information which is voluntarily submitted in feedback forms on the Site or any survey that you accept to take part in is used for the purposes of reviewing this feedback and improving the LibreCall Licensed Application, products and websites.
We may also collect error-reporting information if the Service crashes or hangs up so that we can investigate the error and improve the stability of the Service for future releases (information may be used for: internal operations, including troubleshooting problems, data analysis, testing, research, improvements to the Service, detecting and protecting against error, fraud or other illegal activity). In general these reports do not contain personally identifiable information, or only incidentally. As part of these error reports, we receive information about the type and version of your device and browser, the device identifier, the time the error occurred, the feature being used and the state of the application when the error occurred. We do not use this information for any purpose other than investigating and remedying the error.
We may contact you to send you messages about faults and service issues. Furthermore, we reserve the right to use email, the LibreCall Licensed Application or SMS to notify you of any eventual claims related to your use of our software, websites and/or products, including without limitation claims of violation of third party rights.
We may also use the LibreCall Licensed Application to keep you up to date with news about our software and products that you have purchased and/or to inform you about other LibreCall products and related information.
In order to provide you with LibreCall products you have requested, LibreCall may sometimes, if necessary, share your Personal Information (excluding your address book and related information) and traffic data with trusted partner service providers and/or agents, for example: banking organizations or other providers of payment and analytical services, customer support, or hosting services. LibreCall will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. LibreCall will never share your address book information with any third party, except as may be required by law (see below).
The following is a description of how we may share your Personal Information with trusted third party partners. Should we add additional partners, we will immediately update this description:
1. We use third parties to process the payment and/or billing information that you submit on our Site or through the Librecall App to facilitate payment transactions. We require that these third parties take the appropriate organizational and technical measures to protect your personal data and traffic data and to comply with relevant laws, but we are not liable or responsible for these third party transactions. Therefore, you should review such third party terms and conditions before providing your payment or billing information.
2. We may disclose information about you if we determine that for national security, law enforcement, or other issues of public importance that disclosure of information is necessary.
3. Third-party vendors who provide services or functions on our behalf, such as hosting, business analytics, customer service, marketing, distribution of surveys or sweepstakes programs, and fraud prevention.
4. Third-party vendors who may collect information on our behalf, including as necessary to operate features of our Service or to facilitate the delivery of online advertising tailored to your interests.
If you choose to access optional services, such as a website, product or service provided by a third party, including through the Service or LibreCall website, such third party may also collect information about you. Please see the privacy policies of each such third party for more information about how they use the information they collect. This Privacy Policy does not apply to any exchange of information between you and any third party.
These third parties include business partners with whom we may jointly offer products or services, or whose products or services may be offered on our Service or website. You can tell when a third party is involved in a product or service that you have requested because their name will appear, either alone or with ours.
We allow third parties with whom we have a separate agreement to use cookies and other technologies to collect information about the use of our Service, so that they can serve interest-based advertisements to our users and visitors. These third parties include:
1. Business partners, who collect information when you view or interact with one of their advertisements on LibreCall
2. Advertising networks, which collect information about your interests when you view or interact with one of their advertisements.
The information gathered by these third parties is used to make predictions about your interests or preferences so that they can display advertisements on LibreCall and on other sites across the Internet tailored to your apparent interests.
We do not do not share with these third parties any information that would readily identify about you (such as email address); however, these third parties may have access to information about your device (such as MAC address). We do not have access to, or control over, the technologies that these third parties may use to collect information about your interests, and the information practices of these third parties are not covered by this Privacy Policy.
You can remove your data anytime you want. If you do not agree with our Privacy Policy or Terms of Service, please delete your account, uninstall the LibreCall licensed application and discontinue use of the LibreCall Service; your continued usage of the LibreCall Service will signify your assent to and acceptance of our Privacy Policy and Terms of Service. To protect your privacy and security, we take reasonable steps (such as on-device mobile number and mobile operator network verification, or SMS authentication in certain cases) to verify your identity before registering your mobile phone number and granting you access to the LibreCall Service
Please note that, after your account is closed, we may retain certain information associated with your account, including for analytical purposes as well as for record keeping integrity.
Any personally identifiable information that (a) you share in text messages, photos, videos or otherwise with other users, or (b) submit on a blog, social networks, bulletin board or chat room, can be viewed and used by others, including to send you unsolicited messages or to commit identity theft. LibreCall is not responsible for any use or misuse of your information that might result from your disclosure of information.
LibreCall website and Licensed Application clients are not intended for or designed to attract anyone under the age of 16, for that reason, LibreCall does not knowingly collect or maintain Personally Identifiable Information or non-personally-identifiable information on the LibreCall Site or LibreCall Service from persons under 16 years of age, and no part of the LibreCall Service is directed to or intended to be used by persons under 16. If you are under 16 years of age, then please do not use the LibreCall Service or access the LibreCall Site at any time or in any manner.
If we become aware that we have inadvertently received personally identifiable information from a user under the age of 16 years old as part of the Service, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of thirteen as part of the Service.
We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child without parental permission.
In the event that LibreCall goes through a business transition such as being acquired by or merged with a third party entity or sale of all or a portion of our assets, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. Personal Information will likely be among the assets transferred. As part of such a transaction the new entity will be required to commit to the same level of protection of your Personal Information as described in this Privacy Policy.
In the (hopefully) unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.
We will post a notice on this Site of any such change in ownership or control of the Personal Information we may have prior to such transfer.
This Privacy Policy may be revised periodically and this will be reflected by the "effective date" stated. If we make material changes to this policy, we will notify you by publishing a revised Privacy Policy or by means of a notice on our website, or as required by law. Please revisit this page to stay aware of any changes. Your continued use of the LibreCall Site, the LibreCall Licensed Application application and LibreCall Service constitutes your agreement to this Privacy Policy and any amendments.
We reserve the right to update or modify this Policy, or any other of our policies or practices, at any time with or without notice. However, we will not use your Personal Information in a way that is materially different than the uses described in this Policy without giving you an opportunity to opt-out of such differing uses. We will post the revised Policy on the Site, so that users can always be aware of what information we collect, how the information is used and under what circumstances such information may be disclosed. If you do not agree with these terms, you should not use the Site, the Licensed Application, or any other Service.
